Waste Collection Ealing Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Ealing provides waste removal and related services to residential and commercial customers. By placing a booking or using our services you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.
1. Definitions
In these Terms and Conditions, the following definitions apply:
Customer means any individual, business, organisation or other party that requests or uses our waste collection services.
Company, we, us or our means Waste Collection Ealing, the provider of the services described in these terms.
Services means any waste collection, removal, transportation, loading, clearance or related services provided by the Company.
Waste means any refuse, rubbish, junk, bulky items, garden waste, commercial waste, recyclable materials or other materials accepted by the Company for collection and disposal in accordance with applicable laws.
Contract means the agreement between the Customer and the Company for the provision of Services, incorporating these Terms and Conditions.
2. Scope of Services
The Company provides scheduled and one-off waste collection services, including household clearances, small commercial waste collections, garden waste removal and similar collections within our operating area. The precise scope of the Services for each booking will be set out in the confirmation provided to the Customer.
Our responsibility is limited to the collection, transportation and disposal of Waste that we have agreed to accept. We reserve the right to decline any item or load that, in our sole discretion, is unsafe, prohibited, incorrectly described, inadequately prepared or outside the agreed scope of the booking.
3. Booking Process
3.1 Bookings may be made by telephone, email, online form or any other method we make available. All bookings are subject to acceptance by the Company.
3.2 When you request a booking, you must provide accurate and complete information about:
a. The collection address and any access restrictions.
b. The type and approximate volume or weight of Waste to be collected.
c. Any hazardous, bulky or unusual items included in the collection.
d. Your contact details and preferred collection date and time window.
3.3 We may offer an estimate based on the information you provide. This estimate is not binding if the actual Waste, access conditions or workload differ from your description. In such circumstances we may adjust the price, alter the Services or decline the booking.
3.4 A Contract between the Customer and the Company is formed when the Customer accepts our quotation or estimate and we confirm the booking by email, text or other written confirmation.
3.5 The Customer is responsible for ensuring that an authorised person is available at the collection address at the agreed time, unless we have agreed a collection without the Customer being present.
4. Access and Customer Obligations
4.1 The Customer must provide safe, suitable and lawful access to the collection address and to the Waste intended for removal. This includes ensuring that any gates, doors, lifts or communal areas can be used without unreasonable delay.
4.2 The Customer must ensure that:
a. The Waste is clearly identified and separated from items not to be removed.
b. The Waste is not obstructed by vehicles, furniture or other items.
c. The collection area is safe for our staff, with no dangerous conditions such as exposed wiring, unstable structures or aggressive animals.
4.3 If our team, acting reasonably, considers that access is unsafe or substantially more difficult than indicated at the time of booking, we may refuse to carry out some or all of the Services, or may agree additional charges to reflect the extra time, labour or equipment required.
4.4 The Customer is responsible for obtaining any permissions, permits or consents required for access or for the placement of vehicles or containers on private land or shared areas.
5. Waste Types and Restrictions
5.1 The Company will only collect Waste that we are lawfully permitted to handle under UK waste regulations and any relevant licences. Certain items cannot be accepted, including but not limited to:
a. Asbestos or materials containing asbestos.
b. Clinical or medical waste, including sharps and pharmaceuticals.
c. Chemicals, solvents, oils, paints, fuels or other hazardous substances.
d. Gas cylinders, explosives or pressurised containers.
e. Any other item classified as hazardous or requiring specialist handling or disposal.
5.2 If the Customer presents Waste that includes prohibited items, we may at our sole discretion:
a. Refuse to collect the prohibited items.
b. Refuse the entire load.
c. Arrange collection by a specialist contractor at additional cost to the Customer, where appropriate.
5.3 The Customer warrants that all Waste presented for collection is accurately described and is free from prohibited or dangerous materials. The Customer will be liable for any costs, losses, damages or penalties arising from a breach of this warranty.
6. Pricing and Payment
6.1 Prices for our Services are usually based on factors such as the volume of Waste, weight, labour required, access conditions and disposal costs. We may provide a guide price in advance, followed by a final price once our team has inspected the Waste on arrival.
6.2 Unless otherwise agreed in writing, payment is due on or before completion of the collection. We accept payment by the methods stated in the booking confirmation, which may include cash, card payment, bank transfer or other electronic payment services.
6.3 For business customers, we may agree account terms with invoicing after service. In such cases, payment will be due within the period specified on the invoice. We reserve the right to carry out credit checks and to withdraw credit terms at any time.
6.4 If the amount of Waste or the labour required exceeds that indicated at the time of booking, we may revise the price. We will explain any additional charges before proceeding where possible. If you do not accept the revised price, we may cancel the collection and reserve the right to charge a call-out or cancellation fee.
6.5 All prices are quoted exclusive of VAT unless stated otherwise. Where VAT applies, it will be charged at the prevailing rate.
6.6 If the Customer fails to pay any amount due, the Company may charge interest on overdue sums at the statutory rate and may recover all reasonable costs incurred in obtaining payment, including legal expenses and debt collection fees.
7. Cancellations and Amendments
7.1 The Customer may cancel or amend a booking by contacting us as soon as possible using the details provided in the booking confirmation.
7.2 If the Customer cancels more than 24 hours before the scheduled collection time, we will normally cancel the booking without charge, unless specific non-refundable costs have been incurred by us in preparation for the Service.
7.3 If the Customer cancels within 24 hours of the scheduled collection time, fails to provide access, or is not present where required, the Company may charge a cancellation or wasted journey fee to cover costs such as travel, staff time and administration.
7.4 The Company may need to cancel or reschedule a booking due to reasons outside our reasonable control, including traffic disruption, vehicle breakdown, staff illness, extreme weather or legal restrictions. In such cases we will notify the Customer as soon as practicable and offer an alternative date or refund any prepayments for Services not provided.
8. Performance of Services
8.1 We will use reasonable skill and care in the performance of the Services and will endeavour to carry out collections at the agreed time. Collection times are, however, approximate and may be affected by factors beyond our control such as congestion, access delays and unforeseen workload.
8.2 Our team will load the agreed Waste into our vehicle and will take reasonable care to avoid damage to property while carrying out the collection. The Customer should remove or protect any fragile or valuable items near the collection route.
8.3 Unless otherwise agreed, we are not responsible for cleaning or tidying areas beyond basic sweeping after the Waste removal. Deep cleaning, repair or restoration is outside the scope of our standard Services.
9. Title, Responsibility and Disposal
9.1 Once Waste has been loaded into our vehicle and accepted by the Company, title to that Waste transfers to the Company. The Company will then be responsible for transporting and disposing of the Waste in accordance with applicable laws.
9.2 The Company will use licensed facilities and recognised recycling or disposal routes. We aim to divert Waste from landfill where reasonably practicable, subject to local infrastructure and regulatory requirements.
9.3 The Customer acknowledges that exact recycling or recovery rates may vary depending on the composition of the Waste and the availability of appropriate facilities.
10. Liability and Limitations
10.1 Nothing in these Terms and Conditions limits or excludes any liability that cannot be limited or excluded under UK law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
10.2 Subject to the above, the Company will not be liable for:
a. Loss of profits, business, revenue, contracts or anticipated savings.
b. Loss or corruption of data or information.
c. Any indirect or consequential loss or damage.
10.3 The Company will not be liable for damage to driveways, pavements, access routes or surfaces caused by the weight or movement of vehicles, where the Customer has requested or permitted access over such areas.
10.4 The Customer must notify the Company of any visible damage to property or other issues arising from the performance of the Services as soon as reasonably possible, and in any event within 48 hours of completion of the collection. We may request photographs, invoices or other evidence to assist in assessing any claim.
10.5 Our total liability to the Customer in respect of all losses arising under or in connection with the Contract, whether in contract, tort, breach of statutory duty or otherwise, will be limited to the total amount paid or payable by the Customer for the specific Services that gave rise to the claim.
11. Customer Indemnity
The Customer agrees to indemnify and hold the Company harmless from and against all claims, liabilities, costs, damages and expenses arising from:
a. Any breach by the Customer of these Terms and Conditions.
b. The presence of prohibited, hazardous or misdescribed Waste in a load presented for collection.
c. Any failure by the Customer to obtain necessary permissions for access or vehicle placement.
12. Compliance with Waste Regulations
12.1 The Company operates in accordance with relevant UK environmental and waste management legislation, including duty of care requirements relating to the transfer, transport and disposal of Waste.
12.2 Where required, appropriate documentation may be issued for certain collections, including waste transfer notes or consignment details. The Customer must retain any such documents as part of their own compliance obligations.
12.3 The Customer is responsible for ensuring that any Waste presented for collection has been generated lawfully and that they are authorised to arrange its removal. The Customer will not use our Services for any unlawful purpose.
13. Data Protection and Privacy
13.1 The Company will collect and process personal data such as names, addresses and contact details for the purpose of managing bookings, delivering Services, processing payments and handling queries.
13.2 We will handle personal data in accordance with applicable data protection laws and keep it secure and confidential, except where disclosure is required by law or necessary for the performance of the Contract.
14. Force Majeure
The Company will not be in breach of the Contract or liable for any delay or failure to perform the Services where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include, but are not limited to, extreme weather, accidents, road closures, strikes, acts of government, public health restrictions or disruptions to third-party services.
15. Variations to Terms
15.1 The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that Contract.
15.2 Any changes that significantly affect ongoing Services for business customers will, where practicable, be notified in advance.
16. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted, but the remaining provisions will continue in full force and effect.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions and any Contract between the Customer and the Company are governed by and will be construed in accordance with the laws of England and Wales.
17.2 The parties agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.
